Terms & Conditions

PINVERO TERMS OF SERVICE

1. ACCEPTANCE OF TERMS By accessing the Pinvero web app (the "Service"), you agree to be bound by these Terms. Pinvero is a web-based application located at pinvero.com.

2. ELIGIBILITY & AGE RESTRICTIONS

  • Parental Guidance: Persons under 18 ("Minors") must use the Service under direct supervision of a parent or legal guardian.

  • PIN Creation Prohibited: You must be at least 18 years of age to purchase or place a public PIN.

  • Account Termination: Pinvero LLC reserves the right to terminate accounts without refund if a Minor is found to be purchasing services or creating public PINs.

3. THE PIN SYSTEM & INTERACTIVE MAP

  • Permissions: Users must grant "Precise Location" access via their browser to utilize core features.

  • Accuracy Disclaimer: Pinvero LLC is not liable for verification failures, missed XP, or "ghost" pins resulting from hardware/network GPS limitations or signal interference.

  • Placement Rights: Purchase of a PIN grants a digital license for placement. Pinvero LLC reserves the right to move or adjust or delete PINs for map clarity, technical optimization, or to comply with local safety ordinances.

4. COMPLIANCE WITH LAWS & REGULATED GOODS

  • Universal Compliance: All Users and Creators are strictly and solely responsible for ensuring that their Pins, descriptions, and conduct comply with all applicable local, state, federal, and international laws and regulations.

  • Alcohol & Tobacco: All advertising of age-restricted goods must target individuals of legal age (21+ in the U.S.). Creators must comply with all state-specific beverage control (e.g., VA ABC) laws regarding price advertising, happy hour timing, and promotional structures.

  • Cannabis & Regulated Services: In jurisdictions where cannabis or specialty services are legal, Creators must include all mandated license numbers and health warnings within the Pin description.

  • Prohibited Zones: Pins may not be placed in "exclusion zones" (e.g., near schools or places of worship) as defined by local statutes.

  • Right to Remove: Pinvero LLC reserves the right to immediately remove any Pin or suspend any account found to be in violation of any regulatory law without refund.

5. PAYMENTS, SUBSCRIPTIONS, & REFUNDS

  • Digital Goods: All purchases of individual PINs, credits, or "Boosts" are considered final.

  • Subscription Billing: Memberships are billed on a recurring basis. By subscribing, you authorize Pinvero LLC to charge your provided payment method automatically.

  • Strict No-Refund Policy: To the maximum extent permitted by law, all digital purchases and subscription fees are non-refundable.

  • Cancellation: You may cancel your subscription at any time via Account Settings.

  • Chargeback Policy: Initiating a fraudulent credit card chargeback will result in immediate permanent account termination.

6. CREATOR ANALYTICS & DATA

  • Premium Access: The Analytics Dashboard is a paid feature contingent upon an active subscription.

  • Transparency: Users acknowledge that by interacting with a PIN, limited engagement data (time, generalized location, XP gain) is shared with the subscribed Creator for the purpose of verifying "Proof of Presence."

7. PROOF OF PRESENCE & CONDUCT

  • Mandatory Presence: Any Creator who places a PIN must be physically present at that geographical location during advertised times.

  • Violation Penalty: Failure to be present during verification checks is a breach of service and may result in Pin removal without refund.

  • Safe Harbor: Pinvero LLC is a passive conduit and is not liable for the safety or legality of physical locations chosen by Creators.

8. XP-BASED GAMIFICATION

  • No Monetary Value: XP and levels are virtual markers only and hold no cash or real-world value.

  • Anti-Manipulation: Use of GPS spoofing or "farming" bots will result in immediate account termination and forfeiture of all virtual progress.

9. ZERO-TOLERANCE CONTENT POLICY Pinvero LLC maintains a strict zero-tolerance policy for:

  • Sexual Content: No explicit material or links to adult content.

  • Illegal Activities: No facilitation of acts illegal under U.S. Federal or State law.

  • Hate Speech: No content promoting violence or hatred.

10. LIMITATION OF LIABILITY & WARRANTY DISCLAIMER

  • "As-Is" Service: Pinvero LLC provides the Service on an "As-Is" and "As-Available" basis. We make no warranties, express or implied, regarding the accuracy of PIN locations, the safety of physical sites, or the uninterrupted availability of the map.

  • Damages Cap: To the maximum extent permitted by law, Pinvero LLC’s total liability for any claim arising out of these terms or the use of the Service is limited to the amount you paid to Pinvero LLC in the 12 months preceding the event giving rise to the claim.

11. USER SAFETY & ASSUMPTION OF RISK

  • No Duty to Protect: You acknowledge that Pinvero LLC is a digital discovery platform and does not own, operate, or provide security for any of the physical locations, businesses, or events featured on the map. Pinvero LLC owes no "special duty" of care to protect Users from the actions of third parties.

  • Assumption of Risk: By using the Service to navigate to or visit a physical location, you voluntarily assume all risks associated with such activity, including but not limited to: property damage, physical injury, or the criminal acts of third parties. You agree to remain aware of your surroundings and exercise personal judgment at all times.

  • Creator Responsibility: Creators are solely responsible for the safety and legality of the locations where they place PINs. Pinvero LLC does not vet the physical safety of these locations and makes no representation that any location is safe for public access.

  • Mandatory Reporting: If you encounter a location that is unsafe, illegal, or misrepresented, you agree to immediately utilize the "Report PIN" feature within the app.

12. INDEMNIFICATION You agree to indemnify, defend, and hold harmless Pinvero LLC and its owner, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  1. Your use of and access to the Service.

  2. Your violation of any of these Terms.

  3. Your violation of any third-party right, including without limitation any privacy or property right.

  4. Any claim that your content (or a PIN you placed) caused damage to a third party.
